Baqarah 232

 

232- AND IF YOU DIVORCE THE WOMEN AND THEY REACH THE END OF THEIR TERM (EDDA), DO NOT PREVENT THEM FROM MARRYING THEIR FORMER HUSBANDS, IF THEY MUTUALLY AGREE ON EQUITABLE TERMS.  WITH THIS IS INTRUCTED THOSE WHO BELIEVE IN ALLAH AND THE LAST DAY.  THIS IS MORE VIRTUOUS FOR YOU AND PURER, AND ALLAH KNOWS AND YOU DO NOT KNOW.

 

This is another command concerning marriage and divorce.

A Muslim man called Mouqal Ibn Yasser’s sister was divorced.  Her husband did not take her back until her Edda ended.  Then he wished for them to remarry (after the end of Edda, there has to be a new marriage and dowry), but her brother Mouqal refused.  Allah the Highest sent this Ayah down following which Mouqal agreed.  (B: Talaq; 4 & T: Tafseer Sorah 2; 28)

When a man and woman are divorced, and the woman’s Edda ends, the woman’s guardian should not prevent her remarrying her previous husband.  However, there are some conditions which they as well as the woman’s guardian should see to:

1-    It should be by mutual agreement.

2-    This agreement should be made with kindness, justice and honor.

3-    Both spouses should have their rights preserved and their dignity upheld.

Doing this is better for both for:

1-    It is better to obey Allah’s commands.

2-    It is more virtuous for the woman to marry her first husband if he means well, than to marry another man.

3-    It is better to keep the whole family together, and for the children to be brought up by both parents.

Then Allah the Highest reminds us that He knows while we do not know AND ALLAH KNOWS AND YOU DO NOT KNOW”
