234 234- THOSE THAT DIE LEAVING WIVES BEHIND, THEY (THE WIVES) SHOULD
WAIT OBSERVING THEMSELVES FOUR MONTHS AND TEN DAYS. WHEN THEY REACH THE END OF THEIR TERM, THERE
IS NO BLAME UPON THEM CONCERNING WHAT THEY DO WITH THEMSELVES IN AN HONOURABLE
MANNER. ALLAH KNOWS WELL WHAT YOU DO. Further
articles of Law concerning Marriage: Widowed
women should wait for a period of four lunar month and ten days before they may
remarry. This does not go by the
menstrual cycle and is longer than Edda the divorced woman because: 1-
It
is a period of mourning as well as. 2-
A
period for watching for signs of pregnancy. Women
used to mourn their husbands for a year, and they still do in many parts of the
world. Only a husband should be mourned
for this period. Allah’s messenger
prayer and peace upon him said: “It is not
permitted for any woman believing in Allah and His messenger to mourn any one
for more than three days, except her husband, four month and ten days” (B:Janaez;31
& Da:Talaq;12,13 & D:Talaq;46 & A:5;85) The
period of mourning is a period during with the widow does not dress up, be groomed
and be prepared to accept marriage proposals.
The feeling of grief however does not have a time limit. A
woman asked Allah’s messenger prayer and peace upon him: “Allah’s messenger, my daughter’s husband died and she
suffers with eye complaint, can she use some Kohl (eye liner)? He said: “No”
said it twice or three times. Then he
said: “One of you used to stay in mourning for a whole year before Islam”. (B: Talaq; 47 & M: Talaq; 60 & A: 6;
311) There
are two other situations: 1-
A man
dying before the marriage is consummated: The Edda is still 4 lunar month and 10 days,
she is entitled for the full dowry and she inherits. Allah’s messenger’s companion, Abd Allah Ibn Masoud was asked about
a similar case, he said: “I shall answer you
with my opinion, if it is right, it is from Allah, if wrong, it is from me and
Satan and Allah and his messenger have nothing to do with it. She is to have her dowry without being
deprived of any of it should wait for the Edda, and she inherits”. A man called Mouqal Ibn Yasser stood up and
said: “I heard Allah’s messenger prayer and peace upon him pass a similar
ruling in a similar case of Broa bent Washiq”.
Abd Allah Ibn Masoud was very pleased”. (A:1;431 & N:Nekah;57,67 & M:Nekah;18
& T:Nekah;43 & D:Nekah;31) 2-
If a
pregnant woman’s husband dies;
her Edda ends with child birth, regardless of the period. Allah the Highest said: “AND THE PREGNANT WOMEN’S TERM IS TO GIVE BIRTH” (S:65 A:4) “A woman’s husband died while she was pregnant, she
went to Allah’s messenger prayer and peace upon him and asked if she is free to
remarry, and he told her that she is”
